Abstract

With the rapid development of China 's reform and opening up and the market economy , on the one hand , the contract in the social life and interactions play a more important role as a bridge ; On the other hand , the use of contract fraud become a very prominent criminal fraud class crime form . Contract fraud is a fraud contract cover, covert means , the situation is complex , showing a means endless , becoming more intelligent , deception amount and deceived the amount of a growing trend . Clear the object of the crime of contract fraud include not only public and private property ownership, including national contract management system and good faith the market economic order . The crime should be targeted at the interests of the property . Face of endless means of contract fraud , the paper analyzes the common practices of the \In judicial practice , to the illegal possession for the purpose of not only an essential element of the subjective aspect of contract fraud , and also the distinction between contract fraud and an important criterion for ordinary contract dispute . Theorists \take the deception six judicial practice contract fraud identified reference to more accurate conviction and sentencing in judicial practice , and ultimately achieve the purpose of protection of the socialist market economic order .
