Abstract


The transparent principle is the important basic principle and the core aim, which is mainly aim at the publicity and transparent of the trade codes, trade policies, the procurement information and the transparency of the procuremnt patterns and procedures. The GPA, as a special multilateral agreement in the field of the government procurement under the frame of the WTO, establishes the status of the transparent principle in the field of the international government procurement. And the practice of the. international government procurement enrich the connotations of this basic principle and leads the depth development of the jurisprudence of the international government procurement. Lucubrating the appliance and development of the transparent principle in the field of the government procurement means a lot in the process of developing and perfecting the jurisprudence of the government procurement in our country and deal with the challenge from the domestic and international government procurement market.This article starts with the origin, connotation, necessity and the system of law of the transparent principle in the field of the government procurement and tries to making exhaustive discussion of the regularization practice of the transparent principle in the field of the government procurement. Firstly, the article introduces the origin and development of the transparent principle under the frame of the WTO, then it bases on the general theory of the transparent principle and starts from the general theory of the concept of the transparent principle. Troughing analysing the diversified views on the transparent degree of the scholars, it defines the connotation of the transparent degree and the transparent principle. Then it leads to the definition of the transparent principle in the field of the government procurement, especially in the Agreement on Government Procurement. Secondly, the article always treats the regularization of the transparent principle as the theme. In the third part, the article makes some pectinations and comments on the concrete law system of the regularization of the transparent principle from the angle of the transparency of the procurement information and the procurement procedures, and it also finds some deficiencies of the transparent principle in the process of the regularization of the GPA. Finally, the article contraposes disfigurements of the transparent principle in the regularization process, and puts forwards some specific assumes on the perfection of the law system of the transparent principle in the GPA from the aspects of the trade policies and regulations, the law system of the public disclosure of the government procurement information and the regulations of the government procurement procedures and so on.
