Abstract


The rapid development of China 's real estate intermediary market today , the real estate brokerage intermediary to provide convenient information platform to promote the real estate deal while also showing many infringe on the legitimate rights and interests of both the practical problems , such as the real estate transaction process a large number of the real estate agency and staff do not have a valid qualification , illegal operations in the transaction process , false disclosure of information, trading both sides in order to gain against the legitimate rights and interests of such acts . Analysis for many reasons, such as the lack of credibility of the real estate agency practitioners , industry organizations did not play its due role , etc. , but the most important thing is the lack of effective legal regulation , these acts not only damage the reputation and prospects for the development of the real estate intermediary industry , and also seriously infringed upon the legitimate rights and interests of the client , but because of our no special legislation on real estate intermediary , combined with existing regulations is not perfect , imperfect , not only led to a large number of disputes in the field of real estate agents , and also led to the People's Court in the the trial Real Estate Home asked disputes lack of a valid legal basis for such problems . The fundamental purpose of this writing is that from a legal perspective analysis of the above behavior exists for real estate agents , and put forward some reasonable recommendations of the legal regulation of the right medicine . In research methods , the article by historical and comparative analysis of the research methodology , introduces the problems of the development of China 's real estate agency system as well as the field of real estate agents , comparing the broker of the Common Law system and the civil law system of intermediary contract legal regulation , with a focus on the behavior of our real estate agents . Further demonstration of the laws designed for these problems and drawbacks that should establish a strict legal access system , strictly regulate the real estate agency contract to improve the information disclosure system , and clear accountability to intervene in and through the some suggestions reach to more effectively regulate the real estate agency acts to solve a variety of problems exposed in the real estate intermediary services practice .
