Abstract

Small loan companies of a major reform of the financial system and its financing channels for China's rural and urban low-income people, a partial solution to the problem of financing of the part of the population, is an important part of the construction of complete financial ecosystem . This article is emerged in this context, I believe that it is necessary to use the latest data and information, enthusiastic discussion by scholars for a long time in the legal system of small loan companies, and has just revealed to micro-credit the company's survival and management challenges, a research and demonstration, and practice in 2006 on the basis of the legal regulation of small loan companies and their associated system design to further thought and discussion. I hoped that this system combing the results of previous studies, and in accordance with the understanding of the system put forward their views, eventually forming a useful discussion, and the further development of small loan companies to create a favorable legal and institutional space. In addition to the Introduction and Conclusion divided into four parts, including small loan company overview, lack of legal system of small loan companies, small loan companies legal system, to solve the inadequacy of the legal system of the small loan companies. In this paper, based on current research on microfinance and relevant laws and regulations to clarify the meaning of microfinance in the small loan companies, made their views on the future development of the microfinance that microfinance should be broad direction development; author found in the study researchers and legal documents is currently no authoritative definition of small loan companies will be defined based on their own understanding of the concept and nature of small loan companies, and lay a good hope for the whole article theoretical basis, and play the role of attention on this issue; article already mentioned the law of small loan companies more confusion, the author of the current laws and regulations applicable to small loan companies to sort out and based on the results of previous studies on the legal system of the small loan companies and small loan companies involved in the legal relationship sort out the system with the introduction of the; in part reveal small loan companies legal system, the author with the latest data and practical experience do harm to these deficiencies further demonstration and analysis put forward their own views, and may cause serious consequences; how to improve the part of the legal system of small loan companies, the author is to protect small loan company The idea of ??the right to development and to protect the safety of China's financial system as a precondition that the small loan companies that should be given appropriate relaxed environment to grow and develop, should limit the number of potential risk factors, that part of the main around how to let go and limitations are discussed, not only to choose the previous view and analyze argument why the adoption of this view, but also appropriate to put forward their own views, such as the absorption of small loan companies on the issue of deposits, I do not agree with the present more mainstream view that should continue to maintain deposits prohibit small loan companies to broaden the sources of funding for small loan companies, and through other channels.
