Abstract


Criminal reconciliation ,emerged in recent years in our country,is a new method to handle with criminal cases. It bears functional values with regard to construct a socialist harmonious society and is compatible with our nation’ s criminal policy which combines punishment with leniency. Currently, the implementation of criminal reconciliation by organs of the public security, the procuratorate and the court around our country has fruited positive results and is complimented and agreed by classes from top to bottom. This article is to table proposals and plans specific to the problems and deficiency occurred during the implementation of the criminal reconciliation policy in our country based on the author’ s rational analysis on the controversy of the policy and on the reference of the criminal reconciliation policies in countries of different legal systems, so as to give the rein to function of this legal and reasonable policy.The whole article is composed of five chapters: Chapter one, a general description of the controversy over criminal reconciliation by all works of life in our country and the author’ s rational thinking and analysis. Chapter two, the necessity and feasibility of this policy. In this chapter, the author analyses the necessity and feasibility of this policy. Chapter three, the present situation and operating obstacle of criminal reconciliation in our country. In this part, the author summarize the status of the policy in our country and points out its operating obstacle of criminal reconciliation. Chapter four, a comparison of criminal reconciliation policy in countries of different legal systems. In this chapter, the author studies and compares the practice of the policy in other countries and tries to present examples to be followed to consummate the reformation of the policy in our country. Chapter five, the blue-print of the mode of criminal reconciliation in China. In this chapter,the author illustrates the obstacles in the construction of the policy in our country based on the analysis of the necessity and feasibility of this policy, and give the blue-print of the construction of criminal reconciliation policy in our country to finalize the whole article.
