Abstract


In recent years, with China's sustained economic development and the rapid accumulation of national wealth derived from listed companies , private finance , individual investors and foreign hot money private securities investment funds showing a growth spurt , the securities market and is widely active in the field . Private securities investment funds from China's current situation starting looking for in the operational management and legal and regulatory problems and defects in the process of development of the private securities investment funds , and by drawing on the law of development of the private securities investment funds overseas mature markets , mainland China that seeks private direction of scientific development of securities investment funds . Private equity investment fund to withstand the force by virtue of the nature and characteristics of the private placement and risk characteristics , take a pivotal force in mainland China 's stock market is becoming . Development of the private securities investment funds to help meet the needs of different types of investors , improve the structure of China's securities market investors , will help enhance the risk appetite of market participants differentiated positive significance to improve liquidity of the securities market . After several years of development , China 's private securities investment funds already have a certain scale and strong market competitiveness . Private securities investment funds in China does not have a clear legal status , risk management and other aspects of the problem , such as raising the establishment appears and become the bottlenecks that hinder its further development . Through the study of the law of development of the the Overseas Private Securities investment funds as well as learn from the public fund development , detailed analysis and comparison of the Shanghai and Shenzhen private securities investment fund representation of ideas to address the obstacles to development of the private equity fund in the legal system supervision and operations management side and put forward some concrete measures.
