Abstract


In this paper, study and discussion around the responsibility of the carrier system for international air cargo transport, the main line with the responsibility of the carrier system, using historical research, comparative research and case studies by the Warsaw Convention and the Montreal Convention relevant laws and regulations to conduct a study to analyze cases and problems in practice. The first chapter elaborates around the international air cargo transport, introduction of the international air transport concept and international air cargo transport-related international treaties, such as the \to clarify the concept of goods, luggage into this section, together with interpretation, and attempts to explore and resolve the controversy about self Luggage. The second chapter describes the documents of the international air cargo transportation, including air waybill, the baggage check and electronic freight certificate, and in close connection with the practice of practice, including constructive notice sufficient notice, agreed stopping place and cargo weight, quantity, and volume-related issues. The third chapter of the air cargo transport carrier liability regime for the main part of this article, closely focus on the legal provisions of the Warsaw Convention and Montreal Convention, the scope and responsibilities during the carrier's liability attributable to the principle of the defenses and limits of liability and other matters to be addressed. Investigate the destruction of the goods which in the part of the scope of responsibility, loss, damage and cargo delays; discussed part of the responsibility during the time and space from two perspectives; analyzed part in the imputation principle of presumption of fault liability principle and the principle of strict liability and its defenses, and the \The fourth chapter of the status of legislation and legal practice, the problems in China's international cargo air transport legislation, including the issue of carrier responsibility principle, goods transportation certificate and international air cargo transport, application of law, and the legislative proposals. Air cargo is an important part of world trade, China's air cargo market is a is booming in the market. Therefore, I hope the writing of this article can contribute to the continuous improvement in our legislation, continue to promote the development of China's air cargo market.
