Abstract


This article is composed of three parts by the introduction , body and conclusion . The preamble describes the seriousness of environmental problems to force people to wake up from the shackles of anthropocentrism , began to explore the way of harmony with nature , which led to the birth of international environmental law, environmental impact assessment mechanism . Although the mechanism of international environmental law, environmental impact assessment to produce and has been a considerable development , but it is still an imperfect mechanism . The first chapter provides an overview of international environmental law, environmental impact assessment mechanism . This chapter is divided into three sections: Section I introduces the background of international environmental law, environmental impact assessment mechanism ; Section II is to introduce the context of the emergence and development of international environmental law, environmental impact assessment mechanism ; Section III of international environmental law, environmental impact the concept of evaluation mechanisms are clarified. The second chapter described the theoretical and legal basis of international environmental law, environmental impact assessment mechanism . This chapter is divided into two : The first section discusses the theoretical basis of international environmental law, environmental impact assessment mechanism described , respectively, from the perspective of environmental ethics and the basic principles of international environmental law ; Section II introduces the international environmental law, environmental impact assessment mechanism in the embodiment and application of international legal documents . Chapter III of the preliminary framework of international environmental law, environmental impact assessment mechanism . This chapter is divided into three sections: Section I discusses the applicable conditions and objects of international environmental law, environmental impact assessment mechanism ; Section II summarize the subject and content of international environmental law, environmental impact assessment mechanism ; Section III is an international environmental law environmental impact assessment of the specific implementation of the mechanism , including the notification , exchange of information available to the public information and consultation obligations . Chapter IV the significance of pointing to the environmental impact of international environmental law to the status of implementation of evaluation mechanisms and improve the proposal , as well as international environmental law, environmental impact assessment mechanism . The conclusion that the connotation and significance of the mechanisms of international environmental law, environmental impact assessment , it reflects the principles of sustainable development of international environmental law , the precautionary principle, respect for national sovereignty and without prejudice to the foreign environmental principles and principles of international cooperation , it is the implementation of the precautionary principle a procedural rule .
