Abstract


Based on a comparative study between economic public interest litigation and other litigation mechanisms, this article demonstrates the necessity and feasibility of establishing the economic public interest litigation in china in both theory and practice and proposed the legislation idea of the economic public interest litigation. Further, this article also carried on the preliminary design to its basic systems and the necessary measures.There are four parts in the thesis.In part one, the outline of economic public interest litigation systems is given as the premise and foundation in theory for the full text. The article defined some main concepts in this part.The second part discusses the reality for which china should establish the economic public interest litigation. Through several typical cases, the author demonstrated that the procedures available are unable to resolve economic disputes and analyses the reason in the theory.Part three describes the establishment of economic public interest litigation in the theory. In this part, the author analyses in deeper theory the necessity and feasibility of establishing economic public interest litigation.Fourth is about the establishment of the economic public interest litigation system .the author argues that we should enact a separate“economic public interest procedural law”, and give its basic system supporting measures for the safeguards and restrictions in the initial design.
