Abstract


Currently,the public awareness of the law has been gradually strengthened and civil cases are growing.High quality legal judicial identifing system are needed in this circumstance.Because justification of legal judicial identifing procedures are the basis of reasonable judgement and enthusiasm of parties who engage the identifing procedures, construction of reasonable legal judicial identifing procedures are the most important element of the improvement of legal judicial identifing system. Although Chinese Ministry of Justice had promulgated The General Clauses of Legal Judicial Identifing Procedures,there are so mang problems in this field.We can solute these problems by knowing the concept of key words and reserching the legal judicial identifing procedures of foreign conutrirs.This paper consists of four parts.The first part are the intruducction of legal judicial identifing procedure.This chapter not only including many kinds of definitions about legal judicial identifing procedure,but also note the contant of judicial identifing procedure which departed into the start procedure,the judical identification’s implemen,the cross-examination procedure.The second part intruduce the legal judicial identifing procedures of Anglo-American law system and Cival law system and compare them.The third part anlysis the problen and Thepresent situation of Chinese legal judicial identifing procedure.In this chapter,I describe the details of The General Clauses of Legal Judicial Identifing Procedures.The forth part are proposals to perfect Chinese legal judicial identifing procedures.On the basis of right concept,reference of foreign countries’ system and anlysis of Chinese legal judicial identifing procedures,We can construct resonable legal judicial identifing procedures through the guide of right values.
