Abstract


With the development of the tobacco study,a series of research reports point out that tobacco harms human health,at the same time,also aggrieve human life;it is not only hazardous to the life and health of smokers,but also harm to the health of passive smokers.At the same time,the continuous development of the process of globalization,global governance problem has attracted increasing attention of the international community.It has changed from a pure theory of international politics into a pressing problem in practice.Based on the theory of global governance,global governance has affected the object that is or will be the impact of transnational problem of all mankind.Tobacco has become a threat to life and health of all mankind.It is against this background that as human beings recognize hazards of tobacco continued to deepen,and gradually in the world reach a basic consensus-set up mechanisms for global tobacco control.This consensus led to a result,under international organizations,especially the World Health Organization promoted and developed FCTC.The Convention came into effect on February 27,2005.Its entry into force for the tobacco control movement in the world and the rule of law laid the legal foundation.Because tobacco harms human life and health,with the development of the tobacco industry,tobacco hazards become a global public issue,a unilateral state-controlled tobacco out of the limitations highlighted,so it is need to build a global tobacco control legal system. Global tobacco control legal system including the state’s implementation of the minimum requirements for the Framework Convention on Tobacco Control,relevant international organizations operating mechanism for tobacco control and international tobacco control detection mechanism. FCTC came into effect in China on January 9,2006.China’s implementation deficiencies still exist,so it is need to further improve the performance of the relevant legal measures.
