Abstract


Death penalty,which is the severest penalty,could deprive the culprit’s life,so its execution must be very cautious.Death penalty execution system is the last guarantee of the death penalty criminal’s rights,hence it should be more standard,humanism.Through a comprehensive analysis and research of the problem in current death penalty execution system and learning some experiences from abroad,the thesis put forward some advices about our country’s death penalty execution procedure in order to perfect it and benefit the civilization of penal execution procedure in order to perfect it and benefit the civilization of penal execution.The death penalty execution system includes executing death penalty and reprieve. During the process of death execution,the basic conception has the common characteristic of a general criminal case but it also has its particular requirements different from a general criminal case which includes the basic conceptions of justice,human right protection,equality and efficiency etc.Our country’s death penalty execution system has some shortage so that we should improve this system.Firstly,reforming and perfecting the system of reprieve includes following parts:make reprieve become the prerequisite procedure of executing death penalty;enhance the conditions of the alteration from reprieve to executing death penalty. Secondly,perfecting the system of executing death penalty includes following parts: regulate death penalty execution method,and make the injection become the only method; make sure the lawyer take part in the supervision of death penalty;protect the criminal to meet lawyer and relative’s right;perfect the procedure of handling prisoner’s corpse, organ;set up the constitution death penalty amnesty system.
