Abstract


Right to know requires the government information can be open to the greatest extent, in order to meet the needs of the public interest. But the realization of the public should never be at the expense of private interest as the means, the government information is a matter of personal interests should be protected, including trade secrets. Based on the analysis of the connotation of trade secret and the ownership nature as the starting point, summarizes the current legislation status quo of government information disclosure of commercial secrets protection, in order to our country government information public commercial secrets protection and in-depth study of its formation, then in under the guidance of the basic theory of economics analysis of the necessity of government information disclosure of commercial secrets protection system, and analyzes the United States under the government information disclosure of commercial secrets protection system of our country significance, proposed consummates our country correlation system.
