Abstract


Principle of fault liability for tort law is the core of doubt, however, the principle of liability without fault produces the binary system is beginning to show responsibility principle . But in fact no-fault liability is not only difficult to bear the heavy responsibility principle , and even in terms of its institutional theory as there are still a lot of paradox. Moreover, combined with the background of the times today , no-fault liability even on economic, social , cultural and other fields in terms of values ??and ideals are outdated. Thus the principle of fault liability monism return a new era has quietly come.
