Abstract


The project consignment management mode(hereinafter referred to as PCMM) is the application of agency-principal system for non-profit construction project invested by government.The applying of this mode may help the government to overcome the abuses arising out of traditional management mode in which the government is the investor, constructor,manager and final user at the same time.The PCMM shall manage the project more professional;more centralized and is complying with the market rules.Therefore,the quality and project term Can be guaranteed,the investment of the project can be under control and there is no chance for corruption In this respect,the PCMM is set by our country as the reform orientation for the management of construction project invested by the government.However,since there are no laws or regulations specifically define and regulate the application of project consignment management other than instructive documents issued by the State Department and all levels of local government,there are lots of misunderstandings during the practice of PCMM and lead to the problem of law application in legal practice This article will focus on the analyze of PCMM from Agency-Principal system point of view so as to do some help for the establishment of a more efficient PCMM.This article includes four parts:The first part is the general description of the PCMM, in which the writer states the origin and development of the PCMM,the legal definition of PCMM,the basic theory of PCMM in which the writer first talks about the basis of PCMM—Agency-Principal system systematically,then compares PCMM with its origin theory—the advanced project management mode from western world to see the relations and distinctions of these two management modes;The second part studies the location of the characteristic of the PCMM.The third part mainly concerns the Research of the current PCMM.The walter picks up three typical PCMM and analyzes them from aspects of execution,characteristics and legal studies.The fourth part discuss about the legal defects of PCMM,the writer then provides some suggestions on the basis of above-mentioned analysis.In this part the writer first points out the current legal defects of PCMM based on the common practice of PCMM,then the writer provide legal solutions to solve the existing defects.
