Abstract


Great attention has been paid to the environmental problem as it has become so serious a matter all over the world. In the current issue of the increasingly serious environmental situation, the right to public environmental information legislation and open the environmental information in the promotion of public participation in environmental protection is of great significance. So, through the establishment of a special environmental information disclosure legal system to protect the public in the form of environmental information, improve our environmental law system will be in the context of sustainable development on the road to reform and innovate one of the important contents in the new historical conditions.Environmental information disclosure legal system has its strong theoretical foundation. Compared with the developed countries, despite our legal construction of environmental information disclosure has been made obvious progress, there are still serious shortcomings. Some of the basic theoretical problem of the environmental information legislation is not resolved yet. The right to public environmental information is not effective in protecting. The main obligations of environmental information is less. The scope of environmental information is not clear. The procedures of Environmental information disclosure and remedies of rights are not perfect. Our country has not set up a standardized system for environmental information act. On the basis of the current status of our environmental information disclosure’ analysis, under the conditions of the advanced experience of foreign developed countries, it needs the open reform and innovation to our environmental information legislation under the conditions of the advanced experience of foreign developed countries, it needs the open reform and innovation to our environmental information legislation under the conditions of the advanced experience of foreign developed countries. Based on this, I made some ideas for a perfect environmental information transparent in the legislative model, the legislative intent and the fundamental principles, the basic system and environmental information act is of coordination between the relevant laws. I wish it could be summed up experience for the whole of the legislative council in the open information and promote the development of the system of open information through the special legislation of the environmental information disclosure.
