Abstract


The computer software was considered the new century’s emerging industry.The great potential,which it has contributed to popularization of science and technology education in information technology,has been proved.It has an irreplaceable important role in promoting the growth of social wealth and promoting economic and social development.Because of its high-tech features of the rapid development in software R & D,sale,and use the legal matter about it was also came into sight.Software reverse engineering is such a kind of engineering technique that through the conducts of decompilation and disassembly so that we can transform object program into source program.It has not only of great practical significance, but also has sufficient basis for legal theory.This paper is divided into five parts to launch the discussions on this issue.PartⅠ,draw out reverse engineering questions such as how to define reverse engineering, the conditions of reverse engineering,aim of reverse engineering and so on,which is going to discuss through a case referred to reverse engineering that caused many disputes that judged by Shanghai Higher People’s Court in 2006.PartⅡ,define the concept of reverse engineering.Explain the classification after comparing and analyzing various aim of reverse engineering.And then give the scope of reverse engineering that is discussed in this essay.PartⅢ,on the statement of scholars both in the developed counties and our country,the writer’s attitude agrees with the fair use of software reverse engineering by analyzing its theory basic and judgment standard,with the method concerned the science of legal, economic and computer.PartⅣ,from the lawmaking and practice in United States and European Union,we can know that the lawful status and fair use of reverse engineering have been set up with conditions.At present,this regarded as the great significance for us.PartⅤ,Through China’s copyright law and software protection regulations and judicial interpretation of the relevant legislation relating to the provisions of software reverse engineering,pointed out the shortcomings and inadequate of China’s copyright law.China should learn from developed countries to absorb the judicial experience,and improve relevant legislation.With a view to provide the logic of strict administration of justice,the legal basis for operability,the effective protection of compatible software developers access to relevant information and public access to information rights.
