Abstract


The civil litigation contract , refers to the agreements of parties of an action ,in order to make legal effect , which directly or indirectly affects the lawsuit .Although it’s not a major theoretical issue in the field of civil litigation , it was deeply discussed by the scholars in continental legal family such as Germany , Japan and France , however , Chinese civil litigation scholars have paid scant attention to litigation contract . This article is made up of four parts .The content of the first part is conspectus of litigation contract , as the foundation of the later treatises . The second part is about the system base and jurisprudence base for litigation contract. The third part is the central one .The third part is a number of specific system of civil litigation, the focus of this section for the article. On China’s existing laws that already exist in the contract and other related reconciliation system accountable to each other, and introduced the Taiwan region of China’s selection of judges of the desired system, from the specific types of civil contracts in China’s civil contract system into the direction of sound. The last part is about the disadvantages of litigation contract, and prove the essentialness for setting up some districting measures on litigation contract.
