Abstract


Death penalty is the punishment of deprive the criminal’s life.Because life is different form personal freedom,if a criminal who had been depried of life,it is irreclaimable,so it is the most severity and bloody puishment.Since the Italian pendogist beccaria sparkpluged advocate the existence and overthrow of the death penalty,it had been last two hundred years. The right of subsistence is the basic right for people.Rational portect the right of subsistence is the most important assignment of criminal low.No matter how much diifferent about the person’s life we should give the equal protection in the law.In recent years,the existence and everthrow of give the economic crime death penalty became a hot problem in our country’s law circle. Give the captial punshiment to economic criminal is very peculiar in the world.Since the captical punishment divest the most important right of human right of subsistence.The human rights are slowly filtering into people’s minds and the civilization of the rule of law is progressing people are convinced of that death penalty is badly impringe on people’s rights.So abolish the captial punishment for economic crime is the inevitable demand of the human’s civilization of the rule law.The economic crime is typical crime of greedy fortune.The criminals are follow after money, they will not impinge other’s personel safety.Although econimic interest.Economic crime is different form the crime that used the violence to impinge other’s life,endange state and social security.However death penalty is to deprive the criminal’s life and use it in econmic crime is against the principle of the safeguard for human rights.The safeguard for human rights is breakthough point of this text.Though the analysis to the necessity and feasibility of abolish the captial punishment for economic crime and considering the state of legislation about death penalty for economic crime abroad.Thinking that the death penalty for economic crime should be ablished in our country.
