Abstract


In essence, the rights are a product of a conflict of interest between of human beings. Marx believed that the rights of the phenomenon are specific and historical. The right in a socialist society embodies the theory of individual and overall unity, the unity of rights and obligations. Its ultimate aim is to achieve the liberation of humanity and completely freedom of the spirit.Property Law belongs to private law, and it is aim to protect property law. It’s purpose is to deal with the dispute and to achieve the best use of them, to make the best use in order to maximize the mobilization of people’s enthusiasm and work to create wealth.The development of the property law has strong political, economic and social basis in the current China. China’s property law conforms to the Marxist concept advocated by the right and embodied the view on the rights of the individual in a socialist society. It’s core is to protect the property through legal means for citizens (that is, the results of the distribution of benefits), in order to mobilize their production enthusiasm and to promote the development of social productive forces, and eventually contribute to building a harmonious socialist society. Of course, the law is not entirely in physics at the level of law in the form of the Marxist concept of the right to a deduction for a variety of reasons, and certainly there is a difference between inconsistencies, but this is precisely what people need to be explored.Because only understand these issues, people can truly understand why the law is shown by the people of the world have seen this form and what is the reason in this contemporary Chinese in which Marxism guides ideology of the country.The main content of this article is divided into three main parts:The first part: the synthesis about the Marxist concept of the rights, including her production and development process, the main connotation of the theory and practice of value.The second part: the basic spirit of the law, property law, including the legislative background, the purpose of the legislation, as well as in the maintenance of law and property of citizens on the main legal provisions of the analysis. The third part: analysis and evaluate property Law from the Marxist point of view on the rights of law. Look at the property law how to carry out and expand the rights of the Marxist and take form myself attitude.
