Abstract

The divorce relief refers to damage caused by divorce of the marriage party to offer a variety of legal remedies or methods collectively.As an important part of the divorce system,The aim of the system is to safeguard the freedom of divorce and protect the weak in order to achieve the interests of social equity and justice.Therefore,establishing and perfecting the divorce relief system can practically maintain the stability of marriage and families so that the whole society will develop in a harmony way.The article is divided into three chapters : The first chapter is about the outline of the divorce relief system.demonstrating the definition ,basis and its structure.The second chapter mainly camparing and drawing lesson from the legislation of divorce relief system in foreign countries and our country.introducing and comparing Continental Law and countries in the genealogy of Anglo-American Law,and China’s HongKong, Macau and Taiwan’s divorce relief system introduced legislation,as well as domestic and international legislation for the comparison of the above-mentioned reference.The third chapter mainly reviews the divorce relief system in China,analyse the flaws in our legislation of divorce relief system in present condition in our country and proposes means to make it perfect.
