Abstract


Social Law originated in Western capitalist society, which produced on the background of the period of state monopoly capitalism. The Ideological Basis of Social Law is Substantive Justice, Social Joint and so on. The development of Social Law in Europe and the United States and Japan has a long time history, one of Germany set up the first comprehensive system of social law in the world. How to define the scope of Social Law in question has been in controversy. The author took social rights for the protection and implementation approach to the definition of social law at the law department level, while analyzed the current popular "social law is the third jurisdiction", as well as a narrow concept of social law from the negative side. On this basis, the author explored the relationship between the Social Law and the Economic Law preliminary. Although there are some commonalities between the two, but they are independent of each other and helping each other’s legal department. In this paper, the history of observation and comparison of methods on the origin of social law and development are used, concerning about the society in China’s future direction.
