Abstract


In the study of the organizations which are independent from governments and enterprises, and are established and operated voluntarily by, and in accordance with the discretion of citizens, scholars home and abroad generally adopted two different concept systems. Study abroad on this subject tempt to use the concepts of Non-governmental Organization and Non-profit Organization, meanwhile the PRC law adopted the concepts of Social Organization, Private-and-non-enterprise-unit, Foundation, Civil Organization, Institution, Social Intermediary Organization and other related concepts. The questions include but not limited to the following ones: if it is appropriate to use the concepts of NGO and NPO to illustrate the organizations under PRC law? Is there any organization under PRC law can be regarded as NGO or NPO? What are the differences between NGO/NPO and the their counterparts under PRC law? In order to answer those questions, this thesis compared the concepts under PRC law to the concepts of NGO and NPO, and come into a conclusion that: generally speaking, concepts under PRC law can not be regarded as NGO, provided that certain concept meet well with the standards of NPO. From the view of a specific organization, some civil organizations, foundations, private-and -non-enterprises-units can be regarded as NGO or NPO. Thus, the concept use of NGO and/or NGO shall be presented with a specified application field that if it is used to describe a group or a specific organization When applied in describing a specific organization, the privacy, autonomy, non-political, Non-religious features shall be carefully studied.
