Abstract


Water is the basis of the natural resources , but it is also a strategic economic resource . With the social and economic development , water resources worldwide have become a scarce natural resource . Heihe River Basin is located in China 's northwest inland , the scarcity of water resources is particularly evident , water shortage has become a \Rationalize the configuration of this scarce resource , effectively alleviate the shortage of resources . Water rights trading is the rational allocation of water resources , economic instruments, economic instruments often need a law to regulate . How to build the country 's legal system of water rights trading is one of the hot issues of today's environmental legal theory research . This paper summarizes the results of previous studies on the basis of a sustainable development concept as a guide , using a combination of theoretical and practical method to the \starting point, the basic theoretical issues of water rights transactions , clear connotation of water rights and water rights trading , pointed out that the main body of water rights only specific water users assumed by the government in the initial allocation of water rights just the manager's role , but the government through the repurchase of water rights as a general civil subject involved the trading of water rights ; establishment of the Heihe River Basin water rights trading legal system , the improvement of legislation is the premise management system is a combination of sound watershed management and regional management foundation, build harmonious water rights trading market mechanism is the key, specific and to determine the mechanism of the principle established water rights trading , the price of water , water rights trading supervision and management .
