Abstract


The presumption of innocence means that anyone should be presurned innocence before he is judged by law .As a principle of innocence of international cricininal procceedings.it has been commonly used by most countries in the world and it has been written into the United Nations Human Kights and criminal justice as well as the constitutional law of many countres in the world.The establishment of the principle of the presumption of innocence marked the rule of law in morden criminal justice democratic and scientific values,it is not just to ensure a basic principle of the fundamental rights of citizens but also shows the democracy,the rule by law,the degree of civilization in the country .China’s current criminal absorbed the pricnciple of innocent presumption,but the consciousness of the innocent presumption has not struck root in the hearts of the people .There is also a departure from the norms of the principle of the innocent presumption in the legislature and consititution and legislature remains some stipulations. Some stipulations and even the principle of the basic spirit openly oppose .So researching and exploring the principle of the innocent presumption is still significant .In the paper ,by analyzing the shortcomings of origins of the presumption of innocence.litigation rules.values as well as criminal suit.judicial practice and the perfection of the innocent presumption in our country .With a view to the adoption of comprehensive comparsion and deeply understanding the presumption of innocence.It makes people more awareness of the law and the relative legislation will be improved as soon as possible.
