Abstract


In this paper, the subject of plea bargaining , including prosecutors, defense lawyers, judges, defendants , victims as research subjects . Paper is divided into four parts: The first part is to examine the basic system of plea bargaining . The second part of the plea bargain around the subject behavior unfold . The third part mainly on the plea bargaining process, the main role of plea bargaining and the interaction between the impact on plea bargaining . The fourth part of the plea based on the behavior of the main results of analysis of the introduction of plea bargaining , in the main , there are still problems . In this paper, the writing process with a literature study , qualitative analysis, interdisciplinary studies , comparative studies and other research methods . First, by investigating the literature to obtain information relevant to examine the history and current status of plea bargaining , can form a general impression about plea bargaining and concepts ; then through descriptive analysis and qualitative analysis method to study the subject of plea bargaining in the transaction process behavioral characteristics ; followed through interdisciplinary research methods to introduce the social role theory of sociology and social interaction theory, the subject in the whole process of plea bargaining in the main role and interdependence relationship of mutual restraint impact on plea bargaining . Finally comparative method , compared to the main body of plea bargaining behavior , analysis of the main aspects of the introduction of plea bargaining in the need to transform the place . Plea domestic research results have been quite rich, but from the main body of plea bargaining plea bargaining system as the starting point for the study is also rare, mainly scattered among a number of papers and books . This paper systematically plea sort out and analyze the behavior of the body , so that the system of plea bargaining from a boring becomes joint participation by the different roles a lively social activities. In the third part of this paper introduces the sociological theory of social roles and social interaction content , subject behavior into the plea bargaining to analyze social relations , which will establish the main one isolated intrinsically linked and found intersubjective interaction and checks and balances. This gives us to understand some of the issues in plea brings a unique perspective , many problems solved .
