Abstract

The fundamental motive that the government implements the new type of rural cooperative medical system is to thoroughly solve the problem that, famers cannot afford the expensive fees ,which should be paid to the hospital and fail to get access to the treatment and to prevent farmers from the poverty caused by illness or returning to poverty due to illness. Raising enough funds is a main obstacle in the implementation of the new rural cooperative medical system as the system cannot meet the farmer’practical demands, especially to those in some underdeveloped areas. As a good thing to the farmers, the reason that why the farmers are not positive for the fund-raising for the new rural cooperative medical system, is deserved to be studied.In addition to the introduction and conclusion, this article is divided into three parts.In the PartⅠ, the author discusses the significance to solve the problem of“having trouble in raising funds. The financing problem is related to many aspects, including that whether the new rural cooperative medical system can be founded, whether its goal can be achieved, whether its development can be sustainable, whether the integration of the urban’and the rural areas’health care system can be reached, and whether the overall operation of social security system can be realized.In the PartⅡ,first , the author proposes that it is difficult to raise funds during promoting the implementation of the new rural cooperative medical care. Second, the author analyzes these difficult problems of making funding caused by institutional factors from the legal perspective. including that the characteristics of cooperative system of serious illness and the reasonable expectation of farmers involve in is out of touch ,the principle of voluntary participation has increased the difficulty of financing, the order of financing affects the enthusiasm of farmers to participate, irrational cost benefit relationship affects the enthusiasm of farmers, Lack of basic voice makes farmers worried on the new rural cooperative medical fund management low level of rural health services weakens incentives on farmers in the new rural cooperative medical care ,that is to say, the author analyzes these on this part respectively .In the PartⅢ, the author proposes solutions to the new rural cooperative medical difficulty by use of legal theory, including that regulars the sound legal system ;the new rural cooperative medical care; clears the main parties who involve in the rights and obligations; ensures the realization of the rights of farmers; improves the level of compensation; improves funding mechanisms; creates incentives for investment in rural health and these five parts, aim at solving the obstacle through the use of normative role of law..
