Abstract


The new rural cooperative medical system is an important solution to the vicious cycle of poverty and ill health. Rural cooperative medical has several decades of historical development,and has achieved some success. After all,which is at the exploratory stage, unable to keep up with social development, farmers still has difficult in see a doctor. In this case, the new-type rural cooperative medical care system came into being. In 2002 the state proposed the establishment of the new-type rural cooperative medical system,which it experimented from 2003, Qianshan County in Anhui Province carried out it in 2007. Now it is at the new stage of development. As far as the current literature about China’s new-type rural cooperative medical system is concerned, most of them are in the fields of sanitation, insurance, medical and agriculture. However, there are few studies on the system in terms of law, For this reason, the paper takes law as the point of view to analyze new-type rural cooperative medical system. As it is still in the pilot phase, there are some problems such as fund management confusion and few expenses claims and so on. The system need be completed and adjusted continuously. Therefore, this paper presents some rational legal suggestions and legal measures.
