Abstract


In recent years,“credit card”as the modern financial payment tool has been widely used on people’s daily life. At the same time, credit card crime also shows an increasing trend obviously, which affect the country’s financial order and people’s property security. The credit card crime in our country’s criminal law, which includes the crime of forged or altered financial instruments, credit card fraud crime,Prevent credit card management and so on. In this paper, I use the comparative research, analysis and induce, case analysis method and so on, by analysis the conception of credit card crime and the concrete accusation in credit card crime, we find that some deficiencies still exist in our country’s credit card crime legislations. By learn the advanced legislations experiences and judicial cases from foreign country, I proposed several aspects proposal, which including put the“forged credit”into the prevent credit card management; separate the“Malicious overdraft”as the credit card abuse management, regulate the theft and use the credit card as credit card crime, in order to improve our country’s credit card crime legislation.
