Abstract


Insider trading , leak insider information crime associated with the development of the securities market after another, with the securities and futures trading behavior go hand attendant , a serious threat to the functioning of a healthy and orderly securities market . Therefore, countries in legislation explicitly prohibited, and showing a punishment heavier legislative trends . China insider trading , disclosure of insider information behavior regardless of the \However , compared with foreign legislation , our laws against insider trading , disclosure provisions of the crime of insider information is sketchy . Whether theorists substantive departments of the many aspects of this crime , there are still differences, led to this crime has caused great difficulties in its application . This paper Hangxiao Steel Case as a starting point , trying to fully study insider trading system , Divulging Inside Information to be helpful to the further improvement of the development of the theory of criminal law and legislation . Discusses the text is divided into six parts : the first part describes Hangxiao Steel merits of the case , and proposed controversial focus : insider information to form ; , how to define insider information ; determination of the main body of the crime problem . The second part describes insider trading , disclosure of the definition of insider information and legal regulation focuses on the characteristics of the insider information , and solve the problem of the present case related . The third section describes insider trading , the leak of the main body of the crime of insider information , and focuses on how to identify informed personnel informed officers of \The fourth objective part of the insider trading Divulging Inside Information , and explore whether the crime of insider trading controversial judicial practice to use insider information for the establishment of the elements and how accurately defined \Part V combined with insider trading, the subjective aspect Divulging Inside Information analysis of controversial issues in the case . Part VI by analyzing full text of our insider trading , disclosure legislative changes of the crime of insider information to make recommendations.
