Abstract


Since the 1990s, the advent of the Internet has brought to the economy and society profound transformation, traditional trade also deeply impact. E-commerce along with the pace of technology developed gradually, instead of the traditional trade plays an increasingly important role in people's daily lives. Ministry of Commerce issued the \employment, the adjustment of economic structure, improve the efficiency of commodity circulation, reduce distribution costs, benefit the livelihood of the transformation of economic development mode inevitable requirement of e-commerce by the initial transactions between enterprises gradually approached the lives of ordinary people, the individuals involved in transactions have been quite common. Internet shopping is a typical way of individual transactions through the network, its unique advantages quickly became a hot topic nowadays. Consumer choice of goods through the network based on the characteristics of the Internet, more traditional means more convenient, but also brought unrest to the protection of consumer rights. Consumers' right to information is one of the online shopping environment. Consumers' right to information is one of the basic rights of consumers, as the social development of the rule of law and constantly improve, people gradually come to understand, and the importance of this right. Its performance is a non-equal relationship, emphasizing the essence embodies the pursuit of freedom and equality in the spirit of the modern law to special protection, given as a \But due to legal with a lag, the rights have not been in the network context of protection, mainly: imperfect legislation, the main responsibility finds difficult, evidence collection difficulties, credit evaluation system untrue. Actual cases based on the special requirements of consumer protection in the online shopping environment immediate needs and network environment system as the starting point, through the analysis of the existing legal provisions, the protection system, regulatory form to identify our country today that the protection of the rights of inadequate consumer protection network transactions in China's legal system: First, clear Internet trading platform service operators, the legal status and responsibilities;, divided from the following aspects to build a network transactions, operators of the burden of proof ; Third, the establishment of credit evaluation system with integrity; fourth, the establishment of micro-litigation dispute resolution mechanism; Fifth, the principle of determining jurisdiction in favor of consumers; Sixth, strengthen administrative supervision.
