Abstract

As the biggest natural grassland in North China, Grassland is the last barrier to prevent sandstorm from invading capital city Beijing. Therefore the ecological environmental quality of Grassland has great influence to the overall ecological environment of Beijing and furthermore the whole area of North China. Many problems occurred during grasslands protection and exploitation which results in the deterioration of Grassland. Meanwhile due to the lack of a long-term treatment to regain its ecology function and production capacity cannot be realized in a short period of time. By studying Yuan Dynasty’s legislation on grasslands protection as well as other countries’grasslands protection systems and legislation then combined with the study of the current conditions of Grassland I have concluded the following main reasons that caused its deterioration. Firstly the enforcement of law for grasslands protection is ineffective. The provisions of civil liability and administrative liability for the act of damaging grasslands are not heavy enough to warn people. Losses have not been made up to; act of damaging grasslands is not prevented from happening again either. There is a lack of penal provision against crimes related to grasslands damaging. Conviction with no measurement of penalty does not give criminals their deserved punishment according to criminal law. Secondly the ways that every sumu adapts to protect grasslands are simple and rough; therefore it turns protection into“tragedy of the commons”. Thirdly without enough financial support for grasslands protection every year the problems of overrun locusts and rats are severe. Fourthly the economic development of relies greatly on exploiting its rich mineral resources; therefore economic development has done the greatest damage to the grassland. After a careful study of the above mentioned problems I now propose my opinion on the protection of Grassland. First of all in terms of legal perspective to improve the legal system for grasslands protection is urgent. Grasslands protection needs not only technical support but also powerful and effective legal support. Secondly to establish and improve the system of grasslands eco-compensation is of equal importance. This can turn subjects that are exploiting the grassland into whom bearing the obligation of protecting the grassland. At the mean time it can also expand financial sources for grasslands protection. Thirdly to have margin system included in grasslands protection system and to have it work together with grasslands eco-compensation system can therefore form a complete system for financing grasslands protection. Lastly government shall put more effort into supervising the enforcement of grasslands protection law.
