Abstract


Intellectual property rights are different countries or different regions of the rights conferred by laws and regulations in determining a person within the time -exclusive, exclusive private rights . Legislation aimed at protecting intellectual property rights holders ' interests , in essence, can be beneficial to society and the dissemination of knowledge and technological progress , but more and more abuse of intellectual property rights appears not only does not reach its original purpose , but to restrict fair competition in the market , hindering technological progress and the development of international trade liberalization . In recent years, our country in order to better adapt to WTO requirements , and more emphasis on high standards of intellectual property protection, intellectual property rights for the abuse did not cause enough attention. So I feel the need to be in-depth study of this issue . This total of four chapters , the first chapter introduces the abuse of intellectual property laws in various countries different meanings , the performance of IPR abuse and the abuse of intellectual property regulation measures ; second chapter of the international legal regulation of intellectual property and the specific treaties, including the \; the third chapter describes respectively the EU, Japan and the United States foreign trade restrictive measures abuse of intellectual property regulations ; Chapter and China by introducing the three cases of abuse of intellectual property , to clarify the status of my abuse of intellectual property , questions of abuse of intellectual property and improve the relevant legal advice. In this paper, a comparative study and empirical analysis of a combination of methods , focusing on the abuse of intellectual property in international trade and its legal regulation , combined with China 's actual situation, to analyze, propose suitable for our abuse of intellectual property relating to restrictions related to legal advice.
