Abstract


With the growing international bunker oil pollution , IMO the gradual strengthening of the importance of fuel contamination , and finally through the efforts of the IMO Legal Committee and its member States , after six years of fuel Convention , and entered into force in 2008 . The entry into force of the Convention on International Ship Pollution damages the legal system is not only to fill the fuel pollution this gap, and a role in boosting the prevention and reduction of marine pollution . China is a maritime country , and actively adding fuel Convention , and China 's entry into force on March 9, 2009 . Since the entry into force of the Convention , in our running well, the effect is significant , and continue to belong to our unique fuel pollution prevention and damage compensation mechanism in the country to establish . However, due to the Convention on the causes and conditions of our country , the Convention there are certain problems in the implementation process , therefore , it is necessary to in-depth study , to ensure the smooth implementation of the Convention on the fuel Convention . This article discusses four parts , the main contents are as follows : the first part introduces the \The second part of the key elements of the Convention of the fuel to be explored . This chapter highlights of the Convention is divided into the scope of liability , compulsory insurance of three parts . On the basis of this division , the article by comparison with other international conventions , the content of the provisions of the Convention , the principle of an active role , and the need to clear analysis of the problem . The third section discusses the problems of fuel Convention . This chapter focuses on analysis in the second part of the basis of the content of the Convention on the inherent theoretical and practical issues , and put forward corresponding countermeasures . The fourth section analyzes the impact on China and its Countermeasures of fuel Convention . This chapter discussed the positive effect on China's legislation, the maritime sector , enterprises and the challenges of the fuel Convention ; countermeasures from three aspects of the legislation, the maritime sector , and the enterprises , China's response to the fuel Convention recommendations. I hope through this in-depth study on the fuel Convention , and constantly improve compliance , and ultimately in our country to establish a sound domestic fuel pollution damages mechanism to learn to play the role .
