Abstract


Open government information is the information age, the building of democracy and the rule of law, an important part. The right to open and transparent state of operation, as well as the people’s active participation of the national social management is an important cornerstone of modern democratic political system. Is a prerequisite for public participation, there is no government information public or the public’s right to know, there can be no public participation. Since 1776, Sweden’s "Freedom Act" gives newspapers the right to freedom of reproduced documents to the present, the government information disclosure has become the world trend of development of the political system. As represented by the United States, some Western countries, the open system of government information and far-reaching and wide-ranging, from the middle of the last century to now,Been in dozens of countries around the world have been carrying out the government information disclosure of theoretical study and gradually established their own government information the public legal system. China from the eighties of last century in various forms have been carried out on the public activities of government information. After more than ten years of rapid development, China’s government information disclosure system of the construction has achieved some success. April 24,2007, the State Council formulated and promulgated the "Regulations on Open Government Information", and on May 1,2008 into effect. Its promulgation and implementation of China to establish a government information disclosure system in the process of an important milestone. However, my Government Information.The establishment of the open system is not achieved overnight, nor is the development of government information disclosure regulations, all are welcome on the tough problems solved. At present, China’s government information disclosure system is not yet perfect, is mainly reflected in the regulations at the legislative level is relatively low, with supporting systems are inadequate, and other laws of convergence is not good enough, a number of related legal system needs further modifications and improvements to the of its research and awareness there are many inadequacies. Therefore, further strengthening the information disclosure system in theoretical research is still an urgent and necessary. This paper mainly uses the constitutional analysis, comparative analysis,Legal interpretation, analysis, theory of information economics research methods to explore the relevance of government information disclosure concepts and theoretical basis, examining the Government’s information disclosure system in abroad and our country’s development process, affirming the "Regulations on Open Government Information," The promulgation of China’s the importance of administrative rule of law and pointed out that China’s "Regulations on Open Government Information," there are still deficiencies, further improving our government information disclosure regime.This component comprises four chapters. The first chapter is an overview of government information public. The use of constitutional analysis, legal analysis, information economics analysis method for the concept of open government information, government information openly discussed the theoretical basis and elaborated. ChapterⅡis foreign government information disclosure system, the third chapter of our open system of government information. These two chapters of the method of comparative analysis of the use of foreign government information openness and information disclosure system of our government carried out a comparative study to explore the open system of government information development process, sum up the advanced experience of information disclosure practices for our open system of government information perfectProvide an analysis of material. ChapterⅣInformation Disclosure of China’s government problems and improve the response. The use of legal interpretation, comparative analysis methods such as open government information in China and causes problems in research and to explore and make our government open system of information on the improvement of measures and recommendations.
