Abstract


Utilitarianism and rights theory ( contract theory ) in the history of the development of a very special position in the liberal , both have long occupied the center of the stage of the Anglo-American political philosophy and the philosophy of law , controversy and conflict between them is the most intense , the most striking . Utilitarianism think : If the main institutions of a society can make most people get the most happiness , this is the good society , and hence justice . However , utilitarianism has a theory of inherent defects , and that the pursuit of human well-being a priority than the maintenance of the rights of individuals . Rolls firmly grasp the utilitarianism of this defect , expand the critique of utilitarianism . In its early two papers , Rolls discern the concept of general rules , within the concept of Rules of Practice and utilitarian associated , pointed out that the utilitarian justice issues into a management decision-making problems , ignoring the moral ties between people . Rawls critique of utilitarianism in A Theory of Justice \\angle deepen the critique of utilitarianism . Follow the process of Rawls 's theory to explore the logical evolution of the relationship the various justifications relied upon in its critique of utilitarianism as well as between different rationale , laid the foundation for us to further explore Rawls ' theory of justice , and also the other hand, we the academia rights provide a reference standard . The latter two issues are more relevant to the realities of China , but due to the limited length of the article and personal capacity , not expanded in-depth in this article can only be continued research .
