Abstract

With the accelerating urbanization process of China, urban construction has made great progress,but there have been a lot of illegal buildings.The continuous spread of illegal buildings have triggering series of social problems and have become a obstacle in socio-economic and urban development.illegal buildings also attracts the attention of governments at all levels. Under this background, This essay carry out the research from a perspective of executing the law of urban management and taking the objective present situation of Jinan illegal buildings and the government situation as the basic points, in order to analyse the incentives for the formation of the illegal construction, reveal the great dangers for urban development and the people’life,. searching problems which exist in the illegal construction governance,and apply the advanced public theory to explore the governance measures for the illegal construction.This essay take the peple-oriented idea and strengthen the good governance concept about public participation as well as build a hamonious soceity theory as the guiding principles in exploring the plight of illegal construction management process. Finally, this essay proposes the concept of illegal building a harmonious governance,namely, in illegal construction management process,.we take the public interest as the value orientation, let multi-interest groups participate in, make the public interest as the values and the good governance as the work targets, utilize the new public administration idea and means to obtain highly effective and continuously stable governance effect.The paper is divided into five parts,and the framwork is:PartⅠ, Introduction. This part start with the present illegal contruction situation and government social background,proposes the questions which need to be solved in the governance work,.For example:Resources waste, incomplete legislation system of related illegal construction governance, violent conflicts and so on. In addition, The public management theory which is used in the structure of this framework has been briefly discussed in this part. PartⅡ, the key point is the illegal construction analysis and the governance plight.This part firstly clears up the concepts of illegal construction,and carries out them in a different category,reveals the dangers exist in illegal construction so as to show the necessity of governance. Then it lists the current law systems for the illegal construction in our country. At last it introduces the problems which exist in governance.PartⅢ, This part elaborates the illegal construction’s present situation and the origin in JiNan, makes an investigation of the governance work and gives the analysis to the illegal construction demolition data. On this basis, we carry a research on the working mechanism of the illegal construction governance.PartⅣ, This section gives some discussions on how to improve countermeasures of the illegal construction,and puts forward an effective and feasible countermeasures in consummating the legislation of the illegal construction governance, reforming for urban management related the administrative law enforcement system, improving the law enforcement official’s quality and the law enforcement environment,establishing the long-term management mechanism and a set of union enforcement mechanism.PartⅤ, This section makes the deeply reflection in the illegal construction governance work under harmonious conception,and puts forth the proposes on illegal construction harmonious governance,public and Non-governmental organization to participate in the illegal construction governance,melting the illegal construction governance in violent conflicts,which express "Good governance"and "Pareto friendly" principles in the government.The illegal construction governance is impossible to be done in one action, but a long-term, complicated task.Through the analysis to illegal construction present and it’s forming reasons,we must have profound reflection on the governance problems in order to constantly improve the countermeasures.Hoping it can play a practical guide to urban construction and make the city governance towards a standardized and legalized road,which will do great benefit to our city.
