Abstract


In recent years, with the development of the world economy , China's total import and export substantial growth and become a global trading power . But at the same time , China has also become the main objective of the developed countries to take trade remedy measures . As of April 2010 , China has become the world for four consecutive years subject to countervailing duty investigations than any other country , which brought to the United States on China 's anti-subsidy investigation to a maximum . Since 2006 the United States initiated on Chinese coated paper products for the first time since the countervailing countervailing investigation , so far the United States on China initiated anti-subsidy investigations up to 25 . Particularly those affected by the financial crisis , in 2009 alone , the United States on China initiated 10 anti-subsidy investigations . This has caused a serious impact on China's exports and employment . Therefore, for the protection of the legitimate rights and interests of Chinese export enterprises , and the maintenance of fair trade , we must strengthen the study of the U.S. countervailing duty investigations . As one of the specific issues in the U.S. countervailing duty investigations , the exigencies of the situation will be directly related to whether the 90 days prior to the preliminary ruling made ??imported products on a retrospective imposition of countervailing duties or not , and its importance is evident . Is particularly necessary for a better understanding of this problem, from the law and practice levels to strengthen its research and discussion . This will better safeguard the legitimate rights and interests of our country and to better deal with the U.S. countervailing duty investigations . To this end, the first and foremost should describe the law of the United States to the exigencies of the situation , the investigating authorities and investigation procedures , so that readers have a preliminary understanding of the exigencies of the situation . Secondly , we should focus on the practice of investigation by the U.S. investigating authorities to emergency situations , and derive the investigating authorities on the interpretation of the law and practice of the requirements or provisions of the law on this issue is not blur the investigating authorities . Again , the response to the United States for the issue of legislation and investigation practice evaluation, in order to explore its merits and deficiencies .
