Abstract


Replacement of the rural homestead is a new initiative to promote urbanization in Shanghai. Many of these links related to administrative approval. In the context of current deepening the reform of administrative approval system and promoting the transformation of government functions, in order to straighten out the various rights and obligations between subjects, we must give a clear definition of the legal nature of the approval of homestead-replacement ,make the reform of administrative approval system more in line with "macro-control, administrative control power and administrative efficiency" values, so that we can provide a more standardized security and the environment for the further replacement-homestead .Firstly,this paper defines several concepts related to the homestead-replacement.secondly,Based on the pilot of Shanghai suburban homestead-replacement,and combined with the theory of the administrative approval,this peper analyzed the nature and the legal relationship of the homestead-replacement.Finally, this paper gave the conclusions .
