Abstract


The Constitution is the fundamental law of the highest legal authority , it provides the fundamental system of a country at the heart of the legal system of a country , as a basic standard of conduct , should have the highest legal authority . In Western countries, the authority of the Constitution has been universally recognized and maintenance , which aired its \The \Achieving this goal requires many systems and ideas based on one of the most important is the well-established constitutional oversight and constitutional review system . However , compared with the authority of the Constitution of our country , whether in form or substance deficiencies . The article first introduces the concept of constitutional authority , and specify authoritative content of the Constitution , then the basis of the analysis of the national constitutional authority introduced and our Constitution authoritative status quo , resulting in China from two aspects of the legislative process and legal run the specific reasons for the lack of constitutional authority . In the system and in theory of our Constitution is the authority , which is undeniable , however , the formal authority does not necessarily bring substantial authority , for a long time , policies and legal authority higher than the authority of the Constitution , in particular the Policy Priority a serious impediment to the establishment of the Constitution of the substance authoritative . The authority of the Constitution has not really established in our country , and inseparable from the unique historical background of our country , but we should be concerned about is the reality of social factors , factors through all aspects of today's socio-economic , ideological , institutional , judicial practice analysis , of the authority building our Constitution envisaged by the proposed system . This includes : the perfect China 's market economy , and to lay the economic foundation for the establishment of constitutional authority ; civic awareness of the Constitution and constitutional beliefs , and to provide an ideological guarantee for the establishment of constitutional authority ; strengthen the construction of a democratic political system , and improve the constitutional amendment , constitutional oversight unconstitutional censorship , provide an institutional guarantee for the establishment of constitutional authority .
