Abstract


With China's rapid economic development and the acceleration of urbanization , the demand for land is also more and more , the collection of rural land is an inevitable phenomenon . And based on the actual experience of the world , the collection of rural land is a necessary stage . Collection of rural land is bound to give a certain degree of compensation of the rural areas and farmers . In the collection and payment of land compensation , the village committee as the rural grass-roots mass self-government organizations undoubtedly played an important role. Rural land law system is not perfect , the village committee in dealing with the issue of land compensation shall lawlessness . This paper proposed the existence of village committees in the distribution of land compensation issues starting from the two cases , and in-depth analysis of the problem . Standardize Village in the issue of lawlessness in the land compensation countermeasures on the basis of this analysis . This article includes three parts : the first part : The court , the focus of controversy and problems caused . This section describes the merits of the two cases . Controversial issues by these two cases that such cases exist . First, the plaintiff is a member of the village collective economic organizations . Second , the village committee 's position in the distribution of land compensation issues. Third, the village committee \Fourth , whether the case belongs to the scope of the jurisdiction of the court . Part II: Analysis for the case . First, the analysis of the status of cases in litigation . Secondly, the identification of the plaintiff collective economic organization membership . Again, the analysis of the effectiveness of the land compensation distribution plan . Finally, the role of the village committees in the allocation of land compensation analysis . Part III: Case Caused thinking . Countermeasures and suggestions of the village committee is the phenomenon of illegal land compensation cases propose solutions , that is clear in the law compensation subject with villagers qualifications ; defined village committee refused to penalties responsibility of the execution of the judgment , and perfect on the Village supervision ; proposed rural collective land property is clearly defined in the Property Law .
