Abstract


The intellectual property system to promote economic development , one of the boosters of scientific and technological progress and cultural prosperity , protection of intellectual property rights and economic, technological , and cultural development of the mutually reinforcing relationship , is also developed and less developed countries among the competition will compete ground. Business method software protection is more intense issue of differences and disputes over the end of the twentieth century in the protection of intellectual property rights issues . Its protection of national development is not balanced , disagreement is inevitable . But the exclusive right to protect the first of its kind since the United States is the first business method software has a mixed reaction to the practice of the countries in this way to protect the business method software . Firstly the introduction of point clear topics , writing the subject and hope , then three parts devoted respectively introduced the concept of business methods and software , the status quo , the history of the development and evolution , protection measures and the status quo and countermeasures . The first part , from profiling analysis of the concept and nature of the business methods and commercial software to analyze the business methods , the twists and turns of the software as well as software patent protection of software and business methods . The second part of the analysis of a business method patent protection : starting from the practical value to the United States to determine the practice of obtaining patent protection , to demonstrate that they meet the practical value business method software patent protection . The third part from the reality of our current intellectual property legal system and law made ??a comprehensive evaluation then expounded the protection of patent rights . The proposed countermeasures including: enhance their understanding and strengthen international cooperation .
