Abstract


Criminal Search System is an important system , its implementation has great mandatory , and in direct violation of the property relative , personal , privacy is a consideration , and as such , the modern criminal law countries have legitimate procedures for the principles of this legal system construction . Whether in search of our legislation , or in the course of judicial practice, there are different degrees of problems that our country has greatly hindered the process of building a socialist society ruled by law . Introduction of the principle of due process in criminal , our search system for legitimate transformation has important practical significance , so this article to criminal due process as the theoretical starting point for exploring our search system reform, in order to make our search system can provide better play its proper functions , and can fully protect the legitimate rights of citizens . This paper is divided into five parts. The first part of the search system, the basic theory are introduced. The second part , through a discussion of the theory of criminal due process summed up in search system justification requirements. The third part of the major developed countries in search of the rule of law system of the use of comparative law to be examined . The fourth part , as a basis , our search system to find out the main problems . The fifth part , through a comparative approach , the author proposes a search system in our country for proper transformation of some of the recommendations.
