Abstract


China's securities market in the effective allocation of social resources, promoting the socialist market economy process, etc., has shown irreplaceable role. Stock market investors interests protection problem is the core issue of the securities market. China's securities law regulation on issues of mistakes that cause the investors' legitimate rights and interests protection mechanism of weakening. If civil litigation mechanism can not have innovation, securities market civil tort will not effectively judicial solution, investors can not get the right to protection. This article from the stock group litigation concept, the securities group lawsuit theory foundation and procedural justice theory and litigation theory analysis, in the foreign group lawsuit system based on the comparative study of China's current representative litigation system in the application of existing problems are discussed. Finally from the investors benefit protection perspective, based on China's specific national conditions, constructing the negotiable securities of our country group lawsuit system.
