Abstract


Civil Retrial Procedure in case of defects as a legal remedy procedure for the realization of the ultimate justice , has played a positive role. In China, the civil retrial procedure there are many problems , despite the 2007 amendments to the \extent affects the function of the realization of its benefits . In this paper, the concept of civil retrial procedure starting to settle procedural justice and procedures as a civil retrial procedure to build the theoretical basis , comparative study abroad in civil retrial procedure , based on the existence of the Civil Retrial Procedure for exploring problems and their causes , and finally Perfecting the proposed civil Retrial Procedure law.
