Abstract


Wetlands, forests, oceans and human survival, development is closely related, is one of nature's most important biodiversity of ecosystems and human living environment, has a unique ecological value, social value and economic value. A long time, since the value of wetlands is not known, in order to promote economic development, the people of wetlands irrational development and utilization of a large area suffered severe damage, resulting in China's wetland resources, facing severe ecological crisis. In addition to the introduction and conclusion, is divided into four parts. Introductory section summarized our wetland status and legal protection of the status quo, while also clarify the motive and purpose of the author studies the legal protection of our wetlands. The first section provides a brief overview of the theoretical basis of the legal protection of wetlands, that ecological holism ethics, the concept of sustainable development and the legal basis. The second part by the introduction of wetland legal protection of the three historical stages, analysis of our wetlands legal protection currently facing: unclear wetland concept of; lack of specialized wetland legislative protection; existing about wetland protection the law bars too dispersed, the lack of coordination; confusion; exist wetland resources management relations are not good for conservation laws. The same time, the part of the legal protection of wetlands such as the Wetland Reserve land tenure issues, the relationship of the government and the market for wetland conservation for further analysis. The third part outlines the legal protection of Wetlands International, is the purpose of the Convention on Wetlands and the legal obligations of States Parties, the U.S. federal and state wetland protection laws and the United Kingdom Natural Reserve System in force for the protection of wetlands, public purchase the system and wetland management agreement, and a simple list of the legal system of protection of wetlands in the Netherlands, Japan and India. At the same time, on the basis of comparative international legal protection of wetlands, draw inspiration: ideologically to reflect the development and protection of equal thought; strike a balance between public interest and private interest; stressed market means to achieve the Government's policy objectives; Note that the coordination between the various regulations and the various departments; emphasis on the role of public oversight. Explore the feasibility and necessity of the fourth part of our wetlands legislation specifically to be conceived and the specialized law wetlands content and the system, that is, through the development of specialized wetland protection laws to create a system of paid use of wetlands, the planning system, permits to a reasonable system of environmental impact assessment system and public participation in the system development, utilization and protection of wetlands. In addition, this section also provides a brief analysis of the content of China on the establishment of the wetland ecological compensation system.
