Abstract


International factoring is a commercial credit investigation and assessment, management and collection of accounts receivable , trade finance and credit risk guarantees the buyer in one of the comprehensive international settlement and financing. The core of international factoring receivables transferred . International factoring business to suppliers and trade contracts between importers based swing. Trading commencement of the contract , the supplier will be transferred to the export accounts receivable factoring business . If it is international dual factoring, export factoring receivables and then transferred to the import factor , ultimately, import factoring formed between the manufacturers and importers of a de facto debt and debt legal relationship. Trade receivables are transferred between the parties must comply with the conditions of the transfer order in the assignment of claims between the parties to produce legal effects . Meanwhile, the international factoring receivables assignment of claims also cause conflict of rights between the different parties on the legal assignment of claims receivable only for these conflicts to be resolved properly , the international factoring business can proceed smoothly. Assignment of receivables on the legal mainly \To improve the international factoring receivables debt transfer legislation , our accounts receivable on sale yet developed specific laws . Provisions of special laws in international factoring receivables transferred the basic legal issues at the same time , but also on the international transfer of accounts receivable factoring problem particularity requirement .
