Abstract


The issue of nationality is an important and complex issues of international law . The nationality of the individual and the state has a very important significance . With the emergence of globalization of immigrants , the Nationality Law of 1980, there are many legal provisions already outdated , some of the terms is apt to cause the the dual nationality phenomenon , improve the nationality of the legal system in China is necessary . To this end, the paper examines the history of the Chinese nationality legislation , the characteristics of the current Taiwan Nationality Act , the development trend of modern nationality law , from the perspective of comparative law , the relevant provisions of the old and the new Chinese Nationality Law , the current cross-strait Nationality Act , the Nationality Law of the Chinese and foreign were compared. The revelation is obtained by comparing the the nationality should adopt a flexible nationality policy should strengthen the protection of the interests of the state and citizens . In view of the current Nationality Act in question on the nationality of children and adults nationality identification , this paper proposes a number of recommendations and improve the citizenship legislation specific ideas : in the form of legislation , through the enactment of the amendment , the introduction of legislation to explain the development of \the Rules way to make up for the inadequacy of the current Nationality Act . On the specific content , should adopt a flexible nationality policy , modify some provisions to improve the Nationality Law .
