Abstract


The prosperity and development of the network works and data information on countries around the world poses challenges the current intellectual property system. Because the network works and the data information form, transmission characteristics, the particularity of technology content and economic value, leaves their rights are more vulnerable to invasion, and has more difficulty in protecting measures. At first, this paper is network copyright relations with traditional copyright and copyright tort and liability are analyzed, and then analyzed the domestic and foreign network copyright protected by the laws of the status quo and predicament. Finally, this paper combining theory and practice of domestic and foreign legal protection of technical measures and right management information problems put forward some views, to protect the copyright law, special law protection has made the thorough analysis, and through the absorption in international conventions and treaties concerning copyright protection for reference advanced experience, provides conforms to China's national conditions, practical and feasible network copyright law to protect the new path.
