Abstract

Post crime is a crime which an officer committs by taking advantage of duty.Considered the specification of the subject and object in post crime,normally it takes a period of time which is called delitescence when the crime is found.Hence,post crime affects more badly to the society and the criminal is punished much later compared to other crime.Consequently,people will lose faith in the public power,which has a negative influence on the stability of our regime and has already became a big problem on the road of China’s socialist construction.This article took the post crime handed by procuratorial organs in an anonymous city for example and had an analysis on the post crime data.Statistics showed that there often was a latent time in post crime,and normally it took around 4 years.Most of the crime hided more than 4 years became concealed crime numbers except those continuing post crime.The latent time in bribery crime was obviously longer than that in crime of corruption,defalcation and misfeasance.Different department,rank and position affected the latent time differently.In addition,the delitescence in post crime appeared in 3 different ways.One of the situation was that the criminal committed crimes continuously in latent time,another one was that the criminal committed crimes from time to time,and the third one was that the criminal stopped for a long time after committing a crime.However,no matter which type,post crime endangered the society all the time.This paper also analyzed the reason why there was always a latent time in post crime,and by analyzing those problems this paper tried to find an effective way to prevent post crime as soon as possible.The research was based on the statistics and real events in a procuratorial organ,and there were 3 parts in this article.The first part was focused on discovering the characteristics and rules in the latent time of post crime by analyzing the data.The second one discussed the reason and motivation,and the third one provided a few ways to prevent post crime.This article combined the statistics and laws together to analyze different situation,it tried to give a real picture about how post crime happened by using many original materials.Hence,this article meant a lot to prevent post crime and corruption.
